Terms And Conditions

In addition to the Frequently Asked Questions or FAQs the following are included in the car rental relating to tires, tools, documents, accessories as well as equipment.  The renter agrees to all terms and conditions printed on the Dimmples60 contract form and to the information written on the contract with the same number and date as these car rental terms.

  1. The renter fully agrees to the terms and conditions of this contract and has received a copy thereof.
  2. The renter has received the mentioned vehicle and its accessories in proper and safe condition.
  3. The renter agrees to return the vehicle to the lessor on the agreed date and place, as written in the contract, or earlier if the lessor so requires. Should the vehicle not be returned on the agreed time, a fee equal to a full day of the rental vehicle shall be charged. However, there is an hour grace period from the time of return.
  4. .Only persons listed on the agreement or otherwise authorized by law and above the age of twenty-one (21) or depending on state/province age requirement shall drive this vehicle.
  5. We may use your deposit to pay any amounts owed to us under this agreement.
  6. There will absolutely be no refunds, except for a repeated mechanical failure.
  7. The car must be operated and driven with great care. The renter shall be liable for all damages to the car and injury sustained by passengers caused by collision or accident, which is not paid by the insurance company of the vehicle.
  8. In case of a collision or accident, the renter must report it instantly to law enforcement authorities and to the lessor and must not leave the scene of the accident or collision until such action has been taken and after the police has arrived on the scene.
  9. Renter shall return the vehicle to the office of the lessor which has been agreed upon at the beginning of the rental period, along with all tires, tools, accessories, and equipment in same condition as it was when received, though ordinary wear and tear is accepted. Lessor may repossess the vehicle without notice at any time if it is illegally parked, used in violation of law, against the terms of this agreement or is apparently abandoned.
  10. Under no circumstances is it permitted to use the vehicle, operate or drive:
    1. ) In violation of state/province laws, or the conditions and terms of this contract.
    2. ) For the transportation of passengers or property against payment.
    3. ) To propel or tow any vehicle, trailer or other objects.
    4. ) By any person other than the renter signing this contract, unless by written consent of lessor.
    5. ) Off-roads, that is; roads that are not marked as normal driving roads on a road map.
    6. ) Operation of Vehicle by person who has used false or misleading information to obtain the Vehicle
    7. ) Operating the Vehicle outside the continental United States and Canada
    8. ) Using Vehicle to engage in an organized or any other speed contest.
  11. Any violation of state/province laws, or of any of the terms or conditions of this contract, by the renter or any other driver which the renter has granted permission to operate or drive the vehicle, renders the renter is fully responsible for all damages done to the vehicle whatever the cause may be.
  12. Lessor shall not be liable for disappearance or damage to any property left, stored, or transported by renter or other persons, in or on the vehicle, either before or after it has been returned to lessor.
  13. Renter agrees to pay lessor on demand:
    1. ) Deposit of the probable rental cost.
    2. ) All expenses incurred by lessor in returning the vehicle back to lessor’s station, if it has been left somewhere else, regardless of condition of the vehicle, roads or weather.
    3. ) A sum equal to the value of all the tires (regardless of road conditions), the tools and accessories which have been damaged, lost or stolen from the vehicle.
  14. Renter is not authorized to have the vehicle, or its accessories repaired or altered. The renter shall not permit any lien to be placed upon the vehicle without lessor’s prior consent. Renter shall pay all unauthorized charges in connection with the use, repairs, or safekeeping of the vehicle.
  15. The rental fee is paid up front. Renter agrees to pay all costs which lessor may incur in collecting payment by law.
  16. Renter agrees to pay all costs to Lessor incurred in collecting payment from Renter. A credit card number or imprint is taken at start of all rentals for security reasons. It may be used to pay all extra charges, including days, extra insurance, parking fines, refilling gasoline, damages, or any cost due to the car rental because of the renter’s use of the car.
  17. Car to be returned clean (no garbage). If returned dirty, $100 charge, and $500 cleaning fee for smoke or ash odors. If renter fails to return the rental vehicle with the exact fuel as at the time of picking it up; for sedans, if your gas or fuel level is less than the level the vehicle was picked up, $50 will be charged and up to $100 for SUVs.
  18. Flat tires caused by road hazards are the renter’s responsibility. If renter gets a flat tire, call lessor for instructions
  19. Renter is responsible to maintain oil and water levels in vehicle engine. If engine fails due to non-maintenance of vehicle fluid levels the renter will be liable for repairs.
  20. If vehicle overheats, renter must immediately turn it off and contact lessor. Failure to do so will make customer fully liable for repair costs.
  21. Parking tickets are the renter’s responsibility. We encourage you to pay them immediately. If you default, we will pay the fine plus $25 handling charge.
  22. Toll Road cost are the renter’s responsibility. We encourage you to pay immediately at check-in or pay later with a $25 handling charge.
  23. Broken glass and other damages, unless caused by an actual accident with another vehicle at fault, are the responsibility of the renter.
  24. Vehicle may be driven or used only in the United States of American and Canada. However, check with your local agent on any other restrictions.
  25. Liability and driver insurance are according to state/province laws. You are responsible for all damages or losses you cause to others. You agree to provide auto liability insurance covering you, us, and the vehicle. You and we reject PIP, no fault, and uninsured or underinsured motorist coverage. Giving the vehicle to an unauthorized driver terminates our liability insurance coverage, if any.
  26. You will indemnify, defend, and hold us harmless from all liability, costs and attorney fees arising out of use of the Vehicle that is more than, or excluded from, the protection provided you, if any, under the policy. The renter can limit liability by purchasing a collision damage waiver (CDW) for a fixed amount which is determined each time by the lessor.
  27. The collision damage waiver (CDW) does not cover:
    1. ) Damages done on purpose or by total carelessness of the driver.
    2. ) Damages caused when the driver is intoxicated, under the influence of drugs, or by any other cause which renders him unfit to safely drive a vehicle.
    3. ) Damages to the engine caused by water, such as when crossing un-bridged rivers or driving in water.
    4. ) Damages which occur while the car is being raced or test-driven.
    5. ) Damages caused through war activity, mutiny, riots, and uproar or by sabotage.
    6. ) Burns on seats, carpets or floor mats.
    7. ) Damages to wheels, tires, springs, batteries, glass (lights & windows), and radio as well as damages caused by theft of certain parts of the vehicle.
    8. ) Damages caused by driving on bumpy roads on parts such as:
      transmission, drive shafts, or other parts in or on the vehicle’s under wagon. Damages which occur on the under wagon when the vehicle hits the uneven road, such as ridges left by road planers, or rocks stuck in the road or the roadside. Same applies to damages which occur when loose rocks or other items hit the vehicle while it is being driven.
    9. Damages caused when the vehicle is driven where driving is forbidden, also by driving off-road, on trails not marked on charts as normal roads, on snow piles, on ice, over un-bridged rivers or streams, on beaches, in dirt or on any other kind of off-roads.
    10. Damages when sand, gravel, ash, lava or other earth materials are blown on the vehicle.
    11. Should the vehicle be moved by sea, damages caused to it by the ocean water will not be paid.
    12. Damages caused by the wind blowing up the door while opening it.
    13. Other cases are referred to the general conditions of the comprehensive vehicle insurance.
    14. leaving the Vehicle and failing to remove the keys or close and lock all doors, windows, and the trunk and the vehicle is stolen
  28. Renter will pay lessor on demand for all charges due under this Agreement that are allowed by law, including, but not limited to:
    1. ) time and usage for the period during which you keep the Vehicle
    2. ) charges for optional services if you elect to purchase any
    3. ) applicable sales use and other taxes
    4. ) loss of, or damage to the Vehicle, which is included in the cost of repair of the retail value of the Vehicle based on valuation methods accepted by the auto insurance industry on the date of the loss if the Vehicle is not repairable, plus loss of use, diminution of the Vehicle’s value caused by damage to it or repair to it, and our administrative fees incurred for processing the claim
    5. ) all fines, penalties, forfeitures, court costs, towing charges and other expenses involving the Vehicle assessed against us or the Vehicle during your rental, unless these expenses are our fault
    6. ) all expenses we incur in locating and recovering the Vehicle if you fail to return it or we elect to repossess the Vehicle under the terms of this Agreement
    7. ) all costs, including pre and post judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this agreement.
    8. ) a 2% late payment fee or the highest amount allowed by law, if lower on all amounts past due
    9. ) One and one half percent per month interest, or the maximum amount allowed by the laws of the state/province where the Vehicle is rented, for monies due but not paid upon return of the Vehicle
    10. ) Fifty dollars ($50.00) plus $5.00 per 2 KM between the renting location and place where the vehicle is returned or abandoned, plus any additional recovery expenses we incur.
  29. No waiver by us of any breach of this Agreement will constitute a waiver of any additional breach or waiver of the performance of your obligations under this agreement. Unless prohibited by law, renter releases lessor from any liability for consequential special or punitive damages in connection with this rental or the reservation of a vehicle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable. This agreement constitutes the entire Agreement between renter and lessor. All prior representations and agreements between you and us are merged into this agreement.
  30. If you cancel your reservation five days before picking up, you will be reimbursed in full. However, if you cancel below five days, 50% of payment will be withheld. No reimbursement can be made for cancellation forty-eight hours to scheduled pick up time.
  31. This contract is subject to final audit and changes by owner. If the renter breaches this agreement, you will be liable for all damage to, or loss of, the Vehicle caused by your breach, unless otherwise provided by law. No term of this agreement can be waived or modified except by a writing that we have signed. If you wish to extend the rental period, you must return the Vehicle to our rental office for inspection and written amendment by us of the due in date or time.

Definitions.

“Agreement” means all terms and conditions found on both sides of this form, any add-on, or any additional material we provide at the time of rental.

“You” or “your” means the person identified as the renter on Page 1, any person signing this agreement, any authorized driver and any person or organization to whom charges are billed by us on the renter’s direction.

All persons referred to as “you” or ““your” are jointly and severally bound by this agreement.

“We,” “our” or “us” means the Rental Agent identified on Page 1. “Authorized Driver” means you, any additional driver approved by us and listed by us on this agreement, and any other driver authorized by the law of the state/province where the vehicle is rented if person has a valid driver’s license.

Unless the law of this state/province requires otherwise, is at least twenty-five (25) years of age, confirm with your local agent.

“Vehicle” means the automobile identified in this agreement and any substitute, and all its tires, tools, accessories, keys, equipment, keys, and vehicle documents.

“Physical damage” means all damage to, or loss of, the vehicle caused by collision or upset; it does not include damage to, or loss of the vehicle due to theft, vandalism, act of nature, riot or civil disturbance, hail, flood, or fire.

“Loss of use” means the amount calculated by multiplying the number of days/weeks/months from the date of damages to the vehicle until it is repaired times the corresponding periodic rental rate, unless otherwise provided by law.

This agreement is a contract for the rental of the Vehicle.

WE MAKE NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT REGARDING THE VEHICLE, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR THAT THE VEHICLE IS FIT FOR A PARTICULAR PURPOSE.

We may repossess the Vehicle at your expense without notice to you if the Vehicle is abandoned or used in violation of law or this agreement. You waive all recourse against us for any criminal reports or prosecutions that we take against you that arise out of your breach of this agreement.


  IMPORTANT DETAILS  ADDITIONAL TO DIMMPLES60 CAR RENTALS TERMS AND CONDITIONS


 Dimmples60 customer,  Thank you for booking with Dimmples60 Car Rentals Noblesville, Indiana. Please, make sure you read this important document which contains some very key information about your reservation, required document,  Insurance or vehicle coverage, pickup/drop off, delivery, contract extension/renewal, payment, fees and more. Our location will do delivery to some customers. Unfortunately, we're unable to allow customers to physically  pick up or drop off vehicles as usual at this location due to RELOCATE PROGRAM being ongoing. AS a result, this update, we’ll offer to do delivery for some reservations made by our customers till we relocate to a new location  where our customers can resume picking up and dropping off vehicles regularly.  RESERVATIONS REQUIREMENTS:  Please, provide the following three (3) main required documents listed below for us to complete your reservation and be able to send reservation confirmation, able to send you our E-SIGN Contract agreement via email. (1)  Active customer Email address that you’ll be receiving all our notifications THRU and Contract documents. (2) Valid Id Card (front and back), (3) Active Insurance card information, (4) Provide an address for delivery and  pickup that our delivery agent will use for delivering the vehicle and picking up the vehicle. Forward all requested or additional documents of your choice or necessary details information via our email: Forward or Email us:  dimmples60indy@gmail.com. Please, do not or never send your credit or debit card information to us by text message or by email even if requested.:  

Note!! A Anon-refundable minimum of one day for that vehicle renting/reserving must be paid including tax and other fees prior to our deliveries. If your insurance refuses to cover our vehicle(s), we can’t do a refund, also ,if  a customer cancel reservation less than 24hrs, this cost can’t be refunded. Once this document is sent to a customer, we believe that the customer has received, review and we cannot issue any refunds based on the  underlined statement.  INFORMATION (I) ON INSURANCE  Dimmples60 agent will verify the active policy/insurance at drop-off/delivery or pick up the location where customer is present and give agent authorization to verify active insurance policy for renting with dimmples60 car rentals.  However, any customers renting is required to have full coverage insurance but if upon verification, the customer cannot provide us insurance coverage for both driver and vehicle and still chooses to sign a renter contract  with us then our agent may offer(agent will have to confirm with customer) a  customer some coverage and to charge an additional amount which will play as coverage on our vehicle/equipment ONLY.  


Note!!, B, the amount to be paid and not including $200 is maintained based on our vehicle(s) coverage confirmed by your(customer’s) insurance company/agent. Moreover, if your insurance company declined  you(customer) coverage for our vehicle(s) then we'll charge the customer an additional daily amount from $25/day up to 100/day for coverage on our vehicle(s) depending on the vehicle class.  INFORMATION (II) ON PAYMENT AND UNAUTHORIZED USED Of VEHICLES/EQUIPMENT:  Our customers are fully responsible for maintaining vehicles or equipment they're renting, making sure the vehicle is at its original stage as pick up upon return. A technical issue beyond customer normal driving experience  may involve which cannot be detailed in our terms and conditions of use but customers should always reach out to our team at the location where the vehicle was rented immediately if any mechanical fault is noticed while  using our vehicle, especially when your vehicle cannot start.    

Note!!, C, Customer should never try to start the vehicle the third (3) time because this may create a malfunctioning of engine and which repair cost will be bill at customer responsibility.  Unauthorized used And Company Actions applies to customer immediately without further notice so we believe the above information reviewed by customer which clearly explained to our customer prior to signing your  contract and customers don’t get any further notice before our team can take action under “Unauthorized Used” which varies and isn’t started in this document clearly but we stated, bellow few INSTANCES WHERE a  customer and vehicle/equipment  is listed Unauthorized used and customer not allowed  to drive the vehicle or operate equipment.  (1) NO, payment, (2) Past due return time and date, (3) declined payments or any payment due that we’re unable to process immediately. It’s the customer’s responsibility to always make sure we have your payment  successfully processed up to the date and by the time the customer has our vehicle. 


Declined payments due to expiration or invalid information that may make payments unsuccessful are considered late payments and  customers will have to pay late payments fee but still under action, (3) suspicious activity on the vehicle noticed, Reckless driving and unauthorized driver driving the rented vehicle different from “you” who rented, also  includes driving in unsafe weather. Vehicle found in an undefined destination or location other than what started while you were renting the vehicle and without confirmed notice from us. Other reasons found that are not  with our terms and conditions can cause “Unauthorized Used Action”.  INFORMATION(III) ON DELIVERY AND PAYMENT  Our delivery cost/fee is based on the location for the delivery and pickup location. The customer is fully responsible for toll all or pickup fee for any vehicle toll until confirm checked in or drop off at rental location so  customer must always drop of vehicle at defined location started on contract agreement. The abandonment of our vehicle causes customer toll fee.  

 

Note!! D, A non-refundable minimum of one day cost for that vehicle renting/reserving must be paid including tax and other fees prior to our delivery. If your insurance refuses to cover our vehicle(s), we can’t do a refund,  also, if a customer cancel reservation less than 24hrs, this cost can’t be refunded. Each time you provide us with your card information for payment, know that we you’re giving us permission to process any refund, also,  always charge you for any payment due plus tax, fee and any late fee so it is the customer’s responsibility to update us all the time with valid card information. By receiving this document with statement above, we cannot  issue any refunds then we’ll charge your card on file for due payment.  

All our Car Rental locations will only accept immediate payment for each contract period. Per management and payment policy, if a customer fails to make payment or payment is past due, that customer is given or granted  a One-Time chance to make payment past due plus 2.5% up to 3% late fee for every one hour late, $16 late fee for 8 hours and up to $72 late fee for every 24hrs depending on the vehicle/equipment class and rates. Moreover,  any customer that fails to renew and make payments immediately isn't allowed to drive the vehicle, which means “unauthorized” use of vehicle or equipment and our team will list the customer under UNAUTHORIZEDUSED  ACTION  LATE PAYMENTS FEE(S) detail.  (a) Compact sedan 2.5% for every one hour late, $16 every 8hrs and $36 for every 24hrs. (b) Full size sedan and similar (5 seats), 2.5% everyone, $16 after every 8hrs and $36 for every 24hrs. (c)Mid-size SUV and similar (5  seats plus), 2.7% after one hour, $29.16 every 8hrs and $58.32 every 24hrs. (d) Full size SUV, Mini van and similar (7 seats plus), 3% for every one hour, $36 for every 8hrs and $72 for every 24hrs. 

 PAYMENTS OPTIONS (IN PERSON AND PHONE CONVERSATION WITH AGENT)  (I) Credit card, debit card, Zelle. (II) Cash (only in person so you can’t extend a contract by this option for immediate payment). Ineligible method, Check and bank account are not eligible for payment so never send your bank  account information to us by anyone even if requested by any agent. All key tags must remain with the key(s) attached. Any missing keys returned without tags. customers will be charged $10 each. Customers are never  allowed to make duplicates of our items, materials belonging to us or even documents while driving the vehicle.    

NOT!!, E; Customer  cannot  claim  damages  for  any  accident  that  threatens  the  life  of  rental/driver  so  please  do  not  drive  our  vehicle  or  equipment  if  you  don't  take  full  responsibility  for  damage  company cannot be held responsible for any malfunctioning of vehicle or equipment that led to accident putting a customer(s) in danger or death when the customer/driver is during our vehicle.  INSTANCES WHERE WE WON’T BE ABLE TO ASSIST CUSTOMER APPROPRIATELY:  to  your  own  personal  life.  our  Note!!, E, Customers must notify us prior to contract end/expires. If you wish to extend your contract, please notify us not less than 2hrs prior to the contract expiration date and time otherwise, we assume you're returning  the vehicle following pickup time on contract documents. Extension of a contract can be denied or accepted based on our customer service needs. We only cover our vehicles, and past due amount creates a GAP on  customer’s vehicle coverages/any assistance even if customer pays later. Declined case assistance or coverage scenario: (A customer agrees to pay $30/day for insurance on our vehicle and has just signed a contract  starting today 1:00PM, made payment today at 1:02Pm, but was involved an accident today at 1:01pm)   


Note!!, F, per our policy, if a customer doesn’t notify us about ,he/her contract extension, we’ll not be able to provide any information of assistance on incidents or issues faced by the customer for expired contract or when  a customer fails to follow the policy return time or renewal term policy. The amount to be paid by the customer, including coverage of our vehicle per day for a variable vehicle class, is for our vehicle/equipment only and valid  only at that period specified in the contract, then is only effective if paid immediately. However, a day contract, weekly contract, or monthly contract agreement all requires a one-time immediately (when the contract is  signed) payment so daily payments up to a certain number of days do not change a customer contract agreement to weekly or monthly contracts. Although, the total amount made daily may sum up and be equal to weekly  contract rates or monthly contract rates.

  

NOTE!!, G, All Our Car Rental locations will only accept immediately payment for each contract period. Moreover, any customer that fails to renew and make payments immediately isn't allowed to  drive the vehicle, which means “unauthorized” use of vehicle or equipment and No customer should fail to renew contract or return vehicle/equipment on time because if a customer is involved in any king of accident we  can’t accept any requests of acceptance and if you coverage payment that still cannot be cover you the driver because you were our out contract agreement time or limits. 

Note!!, H, daily or one day contracts (daily renewed  per customer’s request). The amount offered per day or paid daily could just be a discount we looked up for you, but your contract team listed is daily and that's why we have allowed you to notify us daily for renewal and get  confirmation from us then make payment due immediately daily.  The same principle applied for 2days, 3days, 4days, 5 days, 6days, Weekly and monthly contracts
